1. Is It Safe to Buy Property In Mexico?
Yes! Buying property in Mexico can be a very safe and straightforward process when
you work with the right professionals.
The key is choosing an experienced real estate agent, ideally with recognized professional credentials, who can guide you through every step of the transaction.
I always recommend working with a reputable real estate brokerage, using a trusted escrow company, and ensuring that all property documentation is properly reviewed before closing.
A knowledgeable agent does much more than help you negotiate the right price. They
coordinate the process, help identify potential problems, and work with the closing team to verify that the property’s legal documentation is in order.
Having personally represented buyers and sellers in numerous transactions throughout my career, I can confidently say that purchasing property in Mexico can be a smooth, secure, and rewarding experience when handled professionally.
2. Can Forgeigners Really Own Property in Mexico?
When you purchase a home in San Miguel de Allende, you can acquire direct ownership, with the property deed (escritura) registered in your name.
You do not need to establish a bank trust to buy a home here.
Bank trusts, known as fideicomisos, are generally required when foreigners purchase residential property within Mexico’s restricted zones:
● Within 50 kilometers (approximately 31 miles) of the coastline.
● Within 100 kilometers (approximately 62 miles) of an international border.
In these areas, a Mexican bank holds legal title as trustee while the foreign buyer enjoys the beneficial rights to use, sell, rent, and pass on the property.San Miguel de Allende is outside the restricted zone, so foreigners can purchase property directly in their own names, subject to the required government authorization.
Another important benefit is that eligible buyers may be able to include a simplified will, known as a testamento público simplificado, as part of their property deed. This allows them to designate who will inherit the property, subject to applicable legal requirements. Your notary can confirm eligibility and whether any additional charges apply.
3. Can I Finance a Home in Mexico, or Do I Need to Pay Cash?
Most real estate transactions involving international buyers in San Miguel de Allende are cash transactions.
However, financing options are available for foreign buyers through certain specialized lenders.
Interest rates can be considerably higher than those commonly available in the United States or Canada, sometimes around 10% to 12%, depending on the lender, financing product, and buyer qualifications.
Personally, I often recommend purchasing with cash when financially feasible, as financing costs can be significant.
However, if financing is necessary, I can connect you with trusted mortgage specialists who work with international buyers and can explain the available options.
4. Should I Buy a Furnished Home in San Miguel de Allende?
One of the wonderful advantages of buying property in San Miguel de Allende is that many homes are offered fully furnished.
Unlike in the United States, where homes are typically sold without furniture, furnished properties have become very popular in our local market.
Why?
Many homeowners in San Miguel de Allende are American, Canadian, or international residents. When they decide to relocate, transporting their furniture internationally can be expensive and complicated.
As a result, many sellers prefer to include their furnishings in the sale.
For buyers, this can be incredibly convenient. Imagine purchasing a beautiful home and arriving to find it already furnished and ready to enjoy!
Of course, it’s important to confirm exactly what is included in the purchase. I always recommend having a detailed inventory agreed upon by both parties before closing.
5. Can I Buy Property in Mexico as a Tourist?
Yes! You do not need to be a temporary or permanent resident of Mexico to purchase
property here.
Foreign buyers can legally acquire real estate while visiting Mexico as tourists.
You will need to obtain the appropriate authorization from the Mexican Ministry of Foreign Affairs (Secretaría de Relaciones Exteriores, or SRE), as applicable to your purchase.
Your closing team can guide you through the required documentation and procedures. Purchasing a property does not automatically grant Mexican residency, but you can own your home even if you only plan to visit San Miguel de Allende a few months each year.
