Buying Property in Mexico WithoutSpeaking Spanish: How Will I Understand What I’m Signing?

Your Guide to Bilingual Real Estate Documents and Closing in San Miguel de Allende By Romina Garibay | Perfect Home San Miguel

One of the most common concerns I hear from American and Canadian buyers is:

“I don’t speak Spanish. How will I understand the documents I’m signing when buying

property in Mexico?”

The good news is that you don’t need to speak Spanish to purchase a home in San

Miguel de Allende.

At Perfect Home San Miguel, we regularly assist international buyers and have a proces

Your Real Estate Documents Will Be Bilingual

From the moment you make an offer, we arrange for the main transaction documents to be prepared in both English and Spanish, allowing you to review and understand the terms before signing.

These include:

1. Offer to Purchase

Your initial offer outlines the purchase price, payment terms, proposed closing date, and any conditions of the purchase.

2. Purchase and Sale Agreement

This important contract establishes the responsibilities of both buyer and seller, including deposits, inspections, included furnishings, closing arrangements, and other contractual

obligations.

3. Escrow Agreement

When escrow is used, this agreement explains how your deposit is held, the conditions for releasing funds, and how your money is protected throughout the transaction.

All three documents are made available in English and Spanish, and you’ll have the opportunity to ask questions before signing.

What About the Property Deed?

Unlike the previous documents, the official property deed, known as the escritura pública, is prepared in Spanish because it is a Mexican legal instrument.

However, you will not be expected to sign a deed you don’t understand.

At closing, we arrange for an interpreter to assist you as the deed is read and explained in English.

The interpreter helps you understand important details, including the property description, purchase price, ownership information, and legal declarations.

Under Guanajuato’s notarial law, participants who do not understand Spanish must be assisted by an interpreter.

You can ask questions and request clarification before signing.

Can I Speak With the Closing Attorney Beforehand?

Absolutely!

We can arrange a meeting with the attorney handling your closing documentation to answer any questions you may have.

Most of the real estate attorneys we work with in San Miguel de Allende are bilingual, and I’m always happy to participate in these conversations.

My priority is that you feel informed, comfortable, and confident throughout the

purchasing process.
